Red Lake Nation drops trespass charge against Roseau pilot

The Red Lake Nation says it will not charge a Roseau pilot with trespassing after he made an emergency landing on Red Lake Nation land more than seven months ago.

Under a 1978 resolution restricting flights over Red Lake airspace, tribal police seized the plane from Darrin Smedsmo.

The tribe said the rule was created after U.S. military bombing and testing in the area.

The case raised questions about tribal sovereignty and Federal Aviation Administration (FAA) control of airspace.

Smedsmo was given back his plane last week but he said he said he believes it should have been returned sooner because he was never officially charged beyond the original airspace citation.
